These Terms of Use govern your access to and use of the Clay Matter website and your purchase of products offered through it. By accessing this website, placing an order, or otherwise using the site, you agree to these terms.
Throughout these terms, “Clay Matter,” “I,” “me,” and “my” refer to Clay Matter, a studio practice based in Brooklyn, New York.
Products and Availability
Clay Matter offers handmade ceramic objects, all of which are one of a kind.
I make reasonable efforts to describe and photograph each piece accurately. Because the work is handmade and viewed through digital screens, slight differences in color, scale, texture, and appearance may occur.
Product availability is not guaranteed. Placing an item in a shopping cart does not reserve it. An order is not confirmed until checkout has been completed and an order confirmation has been issued.
In the unlikely event that an inventory error allows the same one-of-a-kind piece to be purchased more than once, Clay Matter may cancel and refund the affected order.
Pricing and Payment
All prices are listed in US dollars unless otherwise stated.
Applicable sales tax and shipping charges are calculated and displayed during checkout. You agree to provide current, complete, and accurate billing, payment, and shipping information.
Payments are processed securely by Squarespace Payments, a third-party payment provider. Clay Matter does not directly store complete payment-card details.
I reserve the right to correct typographical errors, pricing errors, or inaccuracies. If an error affects an order you have already placed, I will contact you before fulfilling the order and provide an appropriate resolution, which may include cancellation and a full refund.
Orders
Clay Matter reserves the right to decline or cancel an order when reasonably necessary, including in cases of suspected fraud, payment failure, inventory error, inaccurate listing information, or a shipping destination I cannot reasonably serve.
If I cancel an order after payment has been collected, the amount paid for the canceled merchandise will be refunded to the original form of payment.
Shipping, Returns, and Damage
Orders are subject to the Shipping & Returns policy published on this website. That policy is incorporated into these terms by reference.
Care and Intended Use
Customers are responsible for reviewing the care and use information included in each product listing.
Unless a listing expressly states otherwise, no representation is made that a piece is food-safe, watertight, dishwasher-safe, microwave-safe, oven-safe, or suitable for outdoor use.
Ceramic objects may break, chip, crack, or become hot when used improperly. Handle all pieces with care. Do not expose ceramic work to sudden or extreme temperature changes.
Clay Matter is not responsible for damage caused by misuse, improper care, normal wear, impact, thermal shock, exposure to unsuitable conditions, or use inconsistent with the product description.
Intellectual Property
The website and its contents—including photographs, artwork, product designs, text, graphics, logos, and other original material—are owned by or licensed to Clay Matter and are protected by applicable intellectual-property laws.
You may view the website and share links for personal, noncommercial purposes. You may not reproduce, copy, modify, publish, distribute, sell, exploit, or use Clay Matter content or imagery for commercial purposes without prior written permission.
Purchasing an object does not transfer any copyright, reproduction right, or other intellectual-property right associated with the work or its imagery.
Acceptable Use
You agree not to:
Use the website for unlawful, fraudulent, or abusive purposes
Attempt to interfere with the website’s operation or security
Introduce malicious code or automated systems that burden the site
Collect information about other users without authorization
Reproduce or commercially exploit site content without permission
Misrepresent your identity or payment information

The website may rely on or link to services operated by third parties, including website hosting, payment processing, email marketing, analytics, shipping, and social-media platforms.
Those services are governed by their own terms and privacy practices. Clay Matter is not responsible for the content, availability, or practices of independent third-party websites and services.

The website and its content are provided on an “as available” basis. To the fullest extent permitted by law, Clay Matter does not guarantee that the website will always be uninterrupted, error-free, secure, or free from harmful components.
Nothing in these terms excludes any warranty, right, or remedy that cannot legally be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Clay Matter will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or products purchased through it.
To the fullest extent permitted by applicable law, Clay Matter’s total liability relating to a particular purchase will not exceed the amount paid for the product giving rise to the claim.
These limitations do not apply where liability cannot legally be limited or excluded.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Clay Matter harmless from claims, losses, or expenses arising from your unlawful misuse of the website, violation of these terms, or infringement of another party’s rights.
Governing Law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Nothing in this section prevents a consumer from exercising rights or remedies available under applicable law.
